If this event happened in Texas, he likely doesn't get charged with capital murder. As such, he would not get the death penalty in Texas.
Simple murder in Texas - i.e. I walk up and execute my neighbor in his driveway - is not capital murder in Texas. In summary, to be eligible for the death penalty in Texas, the murder needs to occur during certain other felonies (kidnapping, rape, ...), involve a public servant, murder for hire, multiple murders, during a prison escape, certain terrorist threats, or involving a child under 10.
So, in Texas, he gets life max.

In other news, the Lindsay Clancy jury couldn’t come to a unanimous decision this morning so the judge instructed them to continue their deliberations. 🤷♂️ -
So premeditated murder doesn't qualify for the death penalty in Texas? And Djwag I saw something this morning that two of the women on the jury have been wearing pink, supposedly in support of Clancy, the article that I was reading was saying that in their opinion the best that you can hope for is a hung jury.

I believe that Capital Punishment should cover most all cases of murder regardless of the degree.

Looks like the judge is keeping the death penalty on the table. He ruled that the prosecution presented enough evidence to allow the trial to move forward on all 7 counts. He also said the prosecution established probable cause for the victim-targeting allegation, which allows the capital punishment to remain an option.

Given the mandatory appeals process with the death penalty, the convicted kind of get both. They sit on death row for dang near the rest of their life and then they're still put to death. I wish they would instill a maximum of 1 year post conviction to go through the appeals process and then execute if its not overturned. These judges spending years and years before they'll even hear an appeal is ridiculous in my opinion.

The only downside to the death penalty is that he wouldn't be out in the general prison population.

Yeah I know, i guess for me, I reconcile it by knowing that no matter how much that all those turds like to pretend that they found Jesus after committing a crime so horrific that 12 people decided you need to die for it. They are scared shitless about getting to meet him, and attesting to that sin.

The judges are not the primary group delaying the appellate process. A simple civil appeal often takes a year or more. A complicated civil appeal, easily a couple years start to finish.
Death penalty appeals are far, far more complicated, with far bigger stakes, and both sides - prosecution and the defense - are resource limited. And, in a death penalty appeal, the person is going to be in prison anyway in 99% of the situations. So, sitting in prison doesn't prejudice the state or the defense.
And, the defense can assert claims in Fed Court, or appeal in the Fed system, even after completing state level appeals.
And, and, in criminal cases, screw ups by the defense attorney can entitle the accused to a new trial. In civil cases, Exxon's lawyer screws up, the courts say - sorry Exxon, sue your attorney. In criminal law, thats not a practical solution. Bunch of the defense attorneys are court appointed, and, as a result, make almost nothing. So, awarding money to the family of an innocent guy executed by the state is not a viable solution.
As I've said before, if you want quick appeals and execution, have the tax payer hire and fund big league defense attorneys. The $800+ an hour guys with a big staff of paralegals and investigators. They will get more acquittals, reduce the number of death penalty sentences, but eliminate the bulk of the ineffectual assistance of counsel appeals/reversals.Ranch beef just tastes better.Comment

The delays for civil and criminal cases was so extreme, so extensive, that in 1876 Texas took the extraordinary step of changing the Constitution. This change stripped the Texas Supreme Court of criminal jurisdiction. This process ultimately lead to the creation of the Texas Court of Criminal Appeals which, to this very day, functions as the "Texas Supreme Court" for direct criminal appeals.

In my opnion you are both wrong, Even if they bring back the rope, that will not effect the appeals process, If you are suggesting lynching,,,,, well that won't work either. Beefing up the defense team is not gonna make that much difference, hell half the time it is Dick Deguerin, or Rusty Hardin going Pro Bono to be in the circus. The problem is even after all has been adjudicated, The judge will grant any appeal on technical points, so he is not the 1 judge out of 10,000 that put an innocent man to death.
